Poll: Nine in Ten Want U.S. Involvement in World Health Organization

A poll conducted during the current record-setting flu season and released today by the Better World Campaign reveals strong bipartisan support for the World Health Organization (WHO).

Sixty-one percent of voters express a favorable opinion of the WHO, and 92 percent say that it is important for the United States to both provide funds and be part of the decisionmaking process for the WHO, which works to protect against threats to global health and prevent disease outbreaks around the world. The figures are in keeping with findings of an April 2012 poll, in which 93 percent of Americans said it is important that the U.S. be a WHO member, indicating consistent U.S. support for the United Nations coordinating health agency.

With regards to U.S. spending on international assistance to help people in poor and developing countries improve their health situation, a plurality of voters45 percentsupport keeping the level of U.S. spending the same, 22 percent support an increase in this spending, and 27 percent support a decrease in this spending.

Is the U.S. Supreme Court a ‘Corporate’ Court? Monday March 5, 2012 on The American Law Journal

U.S. Education Secretary Arne Duncan Praises TCC at town hall

The day after President Barack Obama called on community colleges to help produce two million new jobs during his State of the Union address, a member of the president’s cabinet came to Tallahassee Community College to learn and listen. U.S. Secretary of Education Arne Duncan hosted a town hall event at TCC on Wednesday, January 25, with a focus on adult education and the role of workforce training in rebuilding the economy. He was joined by Jim Murdaugh, TCC president, John Chapin, TCCs vice president for workforce development, and Ann Smith, chief nursing officer for Capital Regional Medical Center.

The community turned out in full force, with every seat filled and lines queued up at the microphones for the chance to have a dialogue with Duncan. Questions ran the gamut of education issuesfrom early education to K-12 standardized testing to adult education, workforce training and certificate programs.

One town hall participant wanted to know what help would be offered to part-time college students facing many obstacles to finishing their education.

Duncan turned to TCC President Jim Murdaugh for comment. “At community colleges,” Murdaugh said, “the challenges students face are different than the challenges students face at universities.” The panel agreed that financial assistance should be available for part-time students and those enrolled in non-degree programs that lead to job certification.

Duncan said that the high school dropout rate nationwide is about 25 percent, rising to close to 40 percent for minority students. He noted that there are approximately 240,000 ninth graders in Florida, but only 172,000 twelfth graderswhich means the state is losing 68,000 young people to the streets each year. Duncan explained that President Obama wants to address the high dropout rate by changing the rules so students may not leave school until they reach age 18 or graduate.

“We’ve got to work together to do better. We can’t accept the status quo,” Duncan said. “I can’t overstate how important the role community colleges are going to play, helping our country get back to where we want to go.”

Two audience members questioned the federal Race to the Top and Florida Comprehensive Assessment Test. Duncan said that assessments should be safety nets, and some changes are needed for them to be more meaningful and useful. He said that he would like to see teachers salaries increase significantly in the next few years.

Another issue discussed was the difficulty many students in adult education and non-credit workforce training programs experience trying to qualify for financial aid. Outside of special grants or corporate funds, they are usually ineligible to receive the financial aid and scholarships taken advantage of by full-time and credit-program students. TCCs Kristina Pereira, adult education specialist, pointed out that these students are often seeking to overcome unemployment by updating their skills or training to transition between careersand thus are the students most needing and deserving of financial assistance.

Duncan acknowledged the contradiction these students face. I encourage you to push our administration on this issue.

Duncan said that community colleges are uniquely positioned to help people get the skills they need for high-tech, high-skilled and high-paying jobs, echoing how President Obama described community colleges in his speech the night before as places that teach people skills that local businesses are looking for right now, from data management to high-tech manufacturing. Duncan said that TCC’s Center for Workforce Development is doing an excellent job training individuals to meet specific needs of local employers. TCCs model leads to real jobs in the community.

As U.S. Secretary of Education, Duncan envisions higher education leading the way in rebuilding the American economy and sees adult education playing a prominent role. The United States ranks 16th in the number of college graduates. We used to lead the world. The pipeline to return to the top position is through adult education.

TCC has accepted the call to leadership. The College has established partnerships with more than two dozen businesses in the Big Bend, matching students training with specific private sector needs. In 2010, TCC opened its Advanced Manufacturing Training Center, which offers programs designed to appeal to those who are just entering the workforce and to career-changers. The College also offers adult education classes in Gadsden, Leon and Wakulla counties, and provides flexible education options for learners of all ages, such as day, evening and online classes and express sessions.

Parker Waichman LLP Opposes U.S. Justice Department Effort to Quash Lawsuit over Guatemalan Medical Experiments Conducted by U.S. Government Researchers in the 1940s

Parker Waichman LLP, a national law firm, opposes motions recently filed by the U.S. Department of Justice to dismiss a proposed individual and class action lawsuit seeking reparations for victims of non-consensual medical experiments conducted by researchers for the U.S. Public Health Service in Guatemala in the 1940s. Last March, Parker Waichman LLP and a partner firm filed a class action lawsuit in the U.S. District Court for the District of Columbia against the U.S. Department of Health and Human Services (HHS) and eight current federal officials, including HHS Secretary, Kathleen Sebelius, and Thomas Frieden, Director of the Centers for Disease Control and Prevention (CDC), on behalf of the Guatemalan medical experimentation victims (case number 1:11-cv-00527). As the government admits, the lawsuit arises out of a deeply troubling chapter in our nations history. In addition to compensatory and punitive damages for victims of the Guatemalan experiments and their descendants, the lawsuit seeks a declaration that the Defendants violated human rights and an injunction to prohibit further abuses against Guatemalan residents.

According to the federal complaint, between 1946 and 1948, U.S. government medical researchers working in Guatemala intentionally infected upwards of 1,300 prisoners, soldiers and psychiatric patients with syphilis and other sexually transmitted disease without their knowledge or permission in order to investigate the efficacy of penicillin in treating the diseases. The lawsuit cites two causes of action arising under the Alien Tort Statute for violations of the international prohibitions against medical experimentation on non-consenting human subjects and against cruel, inhuman degrading treatment; and two causes arising under the U.S. Constitution, for the violation of the victims’ right to due process and for subjecting them to cruel and unusual punishment.

The doctor who led the Guatemalan experiments was John C. Cutler, who also helped coordinate the infamous Tuskegee, Alabama, study where 600 black men with syphilis were left untreated for decades starting in 1932 to follow the course of the treatable disease. The lawsuit alleges the decision to conduct research in Guatemala was part of a deliberate plan to continue the Tuskegee testing offshore, where it would not be subject to the same level of oversight as in the United States.

According to a report from Newsinferno.com, President Barack Obama has formally apologized to the victims and called the Guatemala experiments reprehensible and tragic. The President also directed the Presidential Commission for the Study of Bioethical Issues to investigate the experiments. Last September, the Panel released a report which deemed the experiments unconscionable and called on the U.S. government to create a system to compensate people who are harmed by participation in scientific research.

On Monday, January 9, the U.S. Justice Department filed two motions seeking the dismissal of the lawsuit, asserting, among other arguments, that the Federal Tort Claims Act (FTCA) provides immunity to the U.S. government for all claims based on injuries suffered in foreign countries and that the law provides no remedy for the injured Guatemalan plaintiffs. In fact, says the government, Congress has a general interest in protecting doctors like those who experimented on these Guatemalan citizens without their knowledge.

We vigorously oppose the assertions made by the Justice Department in its motions, and we pledge to continue to fight for the rights of Guatemalans harmed by the reprehensible acts committed by U.S. researchers during the 1940s, states Peter Cambs, Senior Litigation Counsel at Parker Waichman LLP.
