Equal Access to Justice in the USA an Unfinished Task, says World Justice Project

The USA continues to lag behind two-thirds of wealthy nations as well as some middle-income countries such as Botswana, Chile and Uruguay, in delivering civil justice, according to the World Justice Projects Rule of Law Index 2012 report.

These findings suggest that no progress has been made to bridge the gap between rich and poor in access to the legal system and to guarantee equal treatment for ethnic minorities, despite the Obama Administrations overarching initiative launched in February 2010. In the area of criminal justice the USA ranks 26th among 97 countries (and 24 out of 29 wealthy nations). In civil justice it ranks 22nd overall and 19th among high income peers. Strengths in checks and balances, free speech and other areas were also found.

Released this week in Washington, D.C., the report ranks countries across eight areas impacting on the rule of law: limits on government power, corruption, security, fundamental rights, open government, regulatory enforcement, civil justice, and criminal justice. The report is the product of interviewing 97,000 members of the general public and more than 2,500 experts in 97 countries.

According to the report, The United States performs well in most dimensions of the rule of law. The country has a well-functioning system of checks and balances (ranking seventeenth) and scores well in respect for fundamental rights, including the rights of association, opinion and expression, religion, and petition. The civil justice system is independent and free of undue influence, but it lags behind in providing access to disadvantaged groups. Legal assistance is frequently expensive or unavailable, and the gap between rich and poor individuals in terms of both actual use of and satisfaction with the civil court system is significant. In addition, there is a perception that ethnic minorities and foreigners receive unequal treatment.

The Nordic countries of Sweden, Denmark, Finland and Norway lead the Western Europe & North America region in most dimensions of the rule of law, followed by The Netherlands, Austria and Germany.

Achieving the rule of law is a constant challenge and a work in progress in all countries. The WJPs Rule of Law Index is not designed to shame or blame, but to provide useful reference points for countries in the same regions, with comparable legal cultures and similar income levels, said World Justice Project founder William H. Romney is Naughtier than Obama, says Christmas.com

Christmas.com, the Official Site of Christmas, released today a high-tech Naughty or Nice list along with a new website and gifting engine targeted to consumers who want to share Christmas with friends and family. The Santa-lyzer analyzes public comments, Twitter updates, and Facebook posts using a technology called sentiment analysis. Initial results found that President Obama had a nice-ness factor of 58.9% vs. 50.36% for former-Governor Mitt Romney.

In re-launching Christmas.com, we wanted to make things easier for people as they enter the busiest time of year, said John Lyotier of Christmas.com. However, we also wanted to make it easier for Santa to determine who has been naughty and who has been nice. This is where Sentiment Analysis comes in.

Sentiment analysis uses natural language processing, computational linguistics, and text analytics to identify and extract subjective information in source materials. In other words, when a person speaks or writes something, their output is an emotional communication to the reader or listener. The analysis of President Obama and former-Governor Romney included the transcripts of the three Presidential Debates, their respective speeches at the Democratic and Republican nominations, and the public Tweets from their official campaign Twitter accounts.

Continued Lyotier, In addition to analyzing the two Presidential candidates, we also looked at the public tweets of more than 30 other public figures: from Eva Longoria (who was rated the nicest), to SnoopDogg (middle of the pack), to Bill Maher (lowest). While our Santa-lyzer indicated that Romney is naughtier than Obama, both candidates were found to be naughtier than 29 of the other 32 people that were analyzed.

Secret Service members who had their clearances pulled after bringing prostitutes back to their hotel while on the job in Columbia (http://bit.ly/HZRSaB) were experiencing a biochemical craving for connection, says relationship and sex therapist Dr. Bonnie Eaker Weil. The organization says they let their boss, President Obama, down with the behavior of these men and it will likely cause additional outrage from the public in regards to taxpayer money being used to hire prostitutes.

“The Secret Service was seen as a badge of honor,” says Dr. Bonnie, “and this revelation has definitely sullied their reputation.” Behavior like this is not uncommon among people with high stress, high-powered jobs. Politicians are frequently getting caught with their pants down – sometimes literally – and it even extends to the Oval Office where not that long ago President Clinton was impeached for engaging in illicit sexual acts on the job.

Dr. Bonnie says this can all be attributed to the biochemical craving for connection. “When people are constantly dealing with a high-stress environment, they’re looking for ways to self-medicate. They’re not thinking clearly and they’re likely looking for experiences that will give them additional highs and make them feel even more powerful.” It’s self-reinforcing she says. The more powerful people feel, the more risks they take, which in turn makes them feel even more powerful.

It’s an addictive cycle, one often started by something like a high-stress or high-powered job. “But it then devolves into just wanting that high to feel good, or to escape,” explains Dr. Bonnie. It becomes a quest for forbidden fruit, to feed the addiction. People with jobs like Secret Service members don’t have to look hard for exciting experiences – they’re in foreign countries, spending time with powerful people, they’re likely to take risks says Dr. Bonnie – and in the right situation, they should!

“The Secret Service’s job often depends on them taking risks, so it can be hard to shut off that behavior and not let it permeate every aspect of their life,” Dr. Bonnie observes. But the very scrutiny and pressure that brings with it so much excitement, is the reason why people in a public service line of work have to be even more careful about their behavior. Says Dr. Bonnie, “by engaging in compromising behavior, they not only let down the President of the United States, they may have compromised his safety. And they will be subject to much harsher

penalties, both from the public and from their own system of review.”
